In the name of God, Amen. I, John Embree of the State of Georgia and County of Columbia being at this time indisposed and at an advanced period of life but of perfect and disposing mind and memory and calling to mind the certainty of death do make and ordain this my last will and testament and touching such worldly substance wherewith it has pleased God to bless me in this life, I devise and dispose of them in the following manner and form that is to say
First, I give and bequeath to my beloved wife Elizabeth one negro man named Lewis, one named Peter, one negro woman named Sue, one named Mariah, one negro boy named Henry and at her death to be equally divided among all my surviving children, share and share alike and it is to be understood that the Division is to be by lot and not by sale.
2nd. I give and bequeath to my beloved son Berryman Embree one negro man named John and one negro Girl named Sophy and her issue.
3d. I give and bequeath to my son Berryman Embree in trust for my daughter Nancy Martin and her son John for their use, support and maintenance the following property, to wit: one negro woman named Peg and her issue, one negro boy named Hal, and one boy named George to her and her heirs forever and should my daughter and her son die, then and in that case the property so willed to her to be equally divided among all my surviving children share and share alike.
4th. I give and bequeath to my daughter Elizabeth Alford one negro boy named Buck and one negro Girl named Lavina and her issue to her and her heirs forever.
5th. I give and bequeath to my daughter Mary Embre one negro man named Sam, one boy named Levi, one negro girl named Flora, one named Bess, one Sylvia and their issue to her and her heirs forever.
6th. I give and bequeath to my wife Elizabeth and my daughter Nancy Martin, and my son Berryman Embree jointly and severally the benefit and profit of my plantation whereon I now live including the plantation and tract of land whereon I now live to be the property of my son Berryman Embree to him and his heirs forever, and after the death of my said wife the one half of the mill and the land appertaining to it to be equally divided among my three daughters, Nancy, Betsy, and Mary, share and share alike and that my son Berryman Embree be considered as agent in trust for my said daughter, Nancy Martin for her part of the said mill. All my stock of every description, waggon and gear, plantation, tools, household and kitchen furniture on the death of my said wife to be equally divided among my surviving children.
Lastly, I nominate, constitute and appoint my son Berryman Embree and my friend Sullivan Harrison executors of this my last will and testament. Ratifying allowing and confirming the same.
In witness whereof I the said John Embree have set my hands and seal this 29th day of October in the year of our Lord 1825.

Adam Jones and Thomas White, two of the witnesses of the written instrument being duly sworn deposeth and saith that they saw John Embree the testator sign, seal and acknowledge the within instrument of writing to be his last will and testament and that the testator was of sound mind and disposing memory at the time of signing the same and they with George Davis, signed the same as witnesses in presence of each other, and in the presence and by the request of the testator.

By the Court of Ordinary, for said county. To all whom these presents shall come. Greeting. Know ye, that on the twenty second day of May in the year of Our Lord One Thousand Eight Hundred and twenty six the Last Will and testament of John Embree late of said County dec'd was exhibited in open Court, and in common form of law provided and admitted to record a copy of which is hereunto annexed and administration of all and singular the goods, chattels, and credits of said deceased was granted to Berryman Embree, one of the Executors in and by said Will made and appointed, he having first taken the Oath and performed all other requisites required by law of him by order of said Court, and by virtue of these presents, legally authorized to administer the goods, chattels, and credits of the said deceased, according to the tenor and effect of the said will and testament and according to Law. And he is hereby required to render a true and perfect Inventory of all and singular the goods, chattels, and credits of the said deceased, and appraised, and returned to this Court according to Law and to render a true and correct account to the said Court of his acting and doing yearly, and every year until his administration is fully completed.
