TRANSCRIBER'S Notes: I have attempted to faithfully transcribe all words as written (including spelling errors) and punctuation (or lack of it) as written. There remain a few troubling words that remain elusive. Those words have been included as they "look" and hopefully will be corrected in the future.
The following is the Disposition which I wish to make of all my property Real and personal to take Effect at my Death - first to pay all my Just Debts - I then Bequeath to my son Mark Hawkins my Negro Woman named Charity and her Child named Charlotte also my Eight day Clock - I Bequeath to the Children and legal Heirs of my son Andrew B. Hawkins my Negro Girl named Martha and Negro Boy named James (Marys Children) I also Bequeath to the Children and legal Heirs of my son Strother M. Hawkins my Negro Woman named Moria and little Girl named Charity (Sarahs Child) I also Bequeath to the Children and legal Heirs of my son Samuel Hawkins my Negro woman named Mary and her Two Twin Children a Boy and Girl not yet named - I also Bequeath to the Children and legal Heirs of my son Abraham B. Hawkins my Negro Boy William and little Girl named Mary - I also Bequeath to my Daughter Mary now Vanlandingham my Negro Woman named Sarah and her Child named James - those Negros are all to be Received at appraised Valuation when Delivered - my Negro men John and Lewis will have to be sold unless arrangements can be made amoungth the heirs to keep them in the family the old woman Nancy is to go at liberty and Live amongst my family where she like best and they are willing to keep her - I order that a small sum of money be taken out of my Estate and put out on Interest for her Benefit should she need it - I Bequeath to my son Samuel Hawkins the Two half Lots of Ground in Palmyra where his house stands on for which he is to be charged fifty Dollars out of what will be coming to him out of my Estate - I also Bequeath to my four sons say Andrew B. Hawkins Strother M. Hawkins Samuel Hawkins and Abraham B. Hawkins fifty Dollars each to be paid to them in Cash Before a Devition of the Estate is made - I also order that all the Balance of my Estate Real and personal be sold and Equally Devided in to six parts say of my whole Estate Giving the Children of Andrew B, Hawkins Strother M. Hawkins Samuel Hawkins and Abraham B. Hawkins Each family one part - But before the Children of Andrew B. Hawkins Receive their part there must be paid off a note I hold on the sd And. B. Hawkins amt $290.00 - and Before the Children of Strother M. Hawkins Receive their part there must be paid off a Balance of a note I hold on the sd Strother M. Hawkins amt. $140.00 - also before the Children on Samuel Hawkins Receive their part there must be one hundred Dollars paid to A.B. Hawkins it being the money Got of Boher Young to pay for the Land - as I promised A.B. Hawkins if Samuel Hawkins failed and cold not pay the money I would see that he should no loose it in the end - I now appoint Andrew B. Hawkins Strother M. Hawkins Samuel Hawkins and Abraham B. Hawkins to be the guardians to their Children and my Lawfull Agents to manage and Take care of the Estate I have willed to their heirs with full powers to sell and convey any Estate in their hands Belonging to their heirs that be though Best to the Interest of them the Negros Excepted they are not to be sold unless guilty of some crime worthy of it - I also order that my sons Andrew Strother Samuel and Abraham have their living for life in the Estate I have left their heirs for their services in said Estate - I also Order that no Interest shall be leded on any note or accounts that I hold against them say my Children - also all notes Receipts must be offset against their claims I also order that should any or all the wives of those sons servive them they shall have the same support from the Estate they had in the Life time of their Husbands During their widowhood but no longer I here make a Reserve Respecting the Negroes should I hereafter think it Best for the Interest to sell any part or all of those Negroes and put the proceed into Landed property I shall do so giving to each family the proceeds of the Negroes willed to them - I acknowledge this to be my last will and Testament.

Be it remembered that on this the 2nd day of Sept. 1850, before me, Thomas E. Hatcher, Clerk of the County Court within and for the County of Marion aforesaid, personally came Merriel Carter and Jesse Carter, subscribing witnesses to the above and foregoing instrument of writing purporting to be the last will and testament of Joseph Hawkins deceased and make oath that they saw the deceased sign and heard him acknowledge the said instrument of writing as and for his last will and testament, that at the time of doing the same he was of sound and disposing mind and memory and fully capable of making a will as they believe, that they signed their names as witnesses thereto in his presence and at his request and in the presence of each other, Subscribed and sworn to before me the day and year first above written.

Lewis Vanlandingham and Mary his wife, Plaintiffs, against Mark Hawkins, Executor of the last will and testament of Joseph Hawkins, deceased, Andrew B. Hawkins, Strother M. Hawkins, Samuel Hawkins, Abram B. Hawkins, and the children of the said Andrew B., Strother M., Samuel, and Abram B., entitled to distribution under the will of said Joseph Hawkins, dec'd, whose names are not stated in plaintiffs' petition, Defendants, Petition for payment of legacies and distribution of the estate of Josep h Hawkins, dec'd This day comes said petitioners by their attorneys, and file their petition, praying the court to order the payment of the legacies made by the last will and testament, and codicil thereto attached, of said deceased, and for general distribution of all the estate of said deceased, and setting forth that all the debts due and owing by the estate of said deceased, have been fully paid off and discharged, and shewing the amounts received by the said plaintiffs and defendants, of said deceased in his lifetime, by way of advancement, & c.-Which petition being examined by the court, is ordered to be filed. And it appearing that the said defendants Andrew B., Strother M., Samuel, and Abram B., and all their children entitled to distribution of the estate of said deceased, are not inhabitants of the State of Missouri:
It is therefore ordered by the court, that you the said defendants Andrew B. Hawkins, and your children as aforesaid, Strother M. Hawkins and your children as aforesaid, Samuel Hawkins and your children as aforesaid, Abram B. Hawkins and your children as aforesaid, be and appear before the Justices of our said county court on Thursday the 5th day of August next, which will be the third day of the August term of our said court, to be begun and held at the courthouse in the town of Palmyra, in the said county of Marion, to shew cause, if any you can, why said orders as prayed for in the plaintiffs' petition, should not be made. And it is furlher ordered, that a copy of this order be inserted in some newspaper printed in this State for eight weeks successively, previous to said August term, to which time this cause is continued.

TRANSCRIBER'S Notes: The following is a printed sign that was posted advertising the sale of Joseph Hawkins' property. I have attempted to partially reproduce the appearance of the sign.
SALE Of Valuable Real Estate.
By virtue of the authority vested in me by the last will and testament of Joseph Hawkins, deceased, I shall, on Monday the 10th day of March next, at the court-house door in the town of Palmyra, offer for sale at public vendue, to the highest bidder, the following Real Estate, the property of the said deceased, to wit: 160 ACRES, The North East quarter of Section Eleven, Township Fifty-seven, Range Six West, lying on South River, about three miles South of the Town of Palmyra. There is on said Tract about 80 acres in cultivation the balance well timbered; three or four fine Springs, and an Orchard, a hewn log Dwelling-house, out-houses, &c. Also, the following Lots in the Town of Palmyra, to wit: Lots Five and Eight, in Block sixty-four, Dickerson's addition, unimproved. Lot One, Block three, Range two west, unimproved. Lot Four, Block four, Range one West, unimproved. Lot Five, Block three in Range three West, on which is situated a Frame Dwelling-House and Stable. The above property will be sold on a credit of twelve months, the purchaser giving bond with approved security.

Hawkins, dec'd, and makes oath that he left the following heirs, towit; Mark Hawkins and Mary Vanlandingham wife of Lewis T. Vanlandingham in said County & State, Saml. Hawkins & Abraham B. Hawkins in California, Strother M. Hawkins & Andrew B. Hawkins in County in the State of Texas the said Abraham B., Saml., Strother and Andrew B. Hawkins, being left agents for their children that he will make a perfect inventory of and faithfully administer all the Estate of the Dec'd., and pay the debts as far as the assetts will extend and the law direct, and all account for, pay and deliver all money and property which shall come to his possession or knowledge and in all things carry out the provisions of the will of the said deceased.
